Three phases are included in the employment-based immigration process:

  1. The labor certification - Also called Program Electronic Review Management (PERM), labor certification will come from the Department of Labor. The sponsoring business must prove that there are no available candidates in the United States who are willing, available, competent, and ready to perform the necessary job.
  2. The visa petition - If you receive an approved PERM labor certification, you will then need to file the visa petition, which must be submitted to U.S. Citizenship and Immigration Services (USCIS).
  3. The application for permanent residence - The final phase of applying for permanent residency is to apply for an immigrant visa or to adjust the status of the employee. In these steps, a great amount of documentation will be required by USCIS.

Categories of Workers - Five Preferences

Acceptance into the country as an employee is based on preference. Employment first preference (E1) is the category that includes priority workers who have the approved Immigrant Petition for Foreign Worker, Form I-140.

Individuals placed in the employment second preference (E2) category are professionals who hold advanced degrees and are persons of exceptional ability. Skilled workers, professionals, and unskilled workers are placed into the third category, which is employment third preference (E3).

Employment fourth preference (E4) includes certain special immigrants. The applicant must be the beneficiary of an approved Petition for Amerasian, Widow(er), or Special Immigrant, Form I-360. The last category, employment fifth preference (E5), includes immigrant investors who are engaging in business endeavors.
